Please read these Terms of Service ("Terms") carefully before using our services. These Terms govern your access to and use of our anti-cheat software ("Software") and any related services provided by us ("Services").
By using our Software and Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our Software and Services.
1.1 Grant of License: We grant you a non-exclusive, non-transferable license to use our Software for the sole purpose of detecting and preventing cheating, unauthorized modifications, or any activities that violate the rules of the supported games and servers. Each license is personal to you and may not be shared with, transferred to, or assigned to any other party. The purchase of a license grants you the right to use the Software but does not transfer any ownership rights or grant you the right to distribute, sell, or sublicense the Software to others.
1.2 Restrictions: You shall not, and shall not allow any third party to: (a) copy, modify, or distribute the Software; (b) reverse engineer, decompile, or disassemble the Software; (c) bypass or interfere with any security measures or technical limitations of the Software; (d) use the Software for any illegal or unauthorized purpose; (e) use the Software to infringe upon the rights of others; (f) remove or alter any copyright, trademark, or other proprietary notices from the Software.
2.1 Prohibited Activities: You agree not to engage in any activity that may interfere with or disrupt the functioning of our Software and Services. This includes, but is not limited to: cheating, hacking, exploiting, or attempting to gain unauthorized access to game servers or other users' accounts. Interfering with or attempting to disrupt the security measures of our anti-cheat software or DRM server. Gaining unauthorized access to the DRM server or its data. Downloading, distributing, or using any unauthorized modifications of the Software designed to bypass security measures. Reverse engineering, decompiling, or disassembling the Software in an attempt to discover vulnerabilities and/or distribute. Distributing denial-of-service attacks or other malicious attempts to interfere with the operation of the DRM server.
2.2 Compliance with Laws: You shall comply with all applicable laws, rules, and regulations while using our Software and Services. You are solely responsible for ensuring that your use of the Software is in compliance with all applicable laws.
2.3 Data Collection and Monitoring: By using our Software and Services, you acknowledge that we may collect and monitor data related to your gameplay behavior, system information, and interactions on game servers to detect and prevent cheating activities. This data may include, but is not limited to, game behavior logs, system information, and player identifiers. For more information, please review our Privacy Policy.
3.1 Data Collection: By using our Software and Services, you consent to the collection, processing, and storage of certain information, including but not limited to: system information, game-related data, user account details, server-related data (e.g., server IP addresses, cheating detection logs), and player behavior logs. We will handle your information in accordance with our Privacy Policy. Please review our Privacy Policy for more details on what data is collected and how it is used.
4.1 Use at Your Own Risk: The Software and Services are provided on an "as is" and "as available" basis. We do not warrant that the Software will be error-free or uninterrupted. You use the Software and Services at your own risk, and we shall not be held liable for any damages or losses arising from your use of the Software.
4.2 Use of Collected Data: We do not warrant the accuracy of data collected through the Software, including any detection of cheating activities. By using the Software, you agree that we are not liable for any inaccuracies in the data or any consequences that arise from its use or misuse.
5.1 No Liability for Consequential Damages: In no event shall we or our affiliates be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our Software and Services.
5.2 Data-Related Liability: In no event shall we be held liable for any direct, indirect, incidental, special, or consequential damages arising from the collection, processing, or use of data related to suspected cheating activities, whether detected through the Software or reported by users.
6.1 Termination: We may terminate or suspend your access to the Software and Services at any time, with or without cause, and without prior notice. Upon termination, you must immediately cease all use of the Software.
7.1 Modification: We reserve the right to modify or update these Terms at any time without prior notice. However, significant changes to these Terms, particularly those affecting your data usage or collection, will be communicated to you via email or through a notification on our website. It is your responsibility to review these Terms periodically for any changes. By continuing to use our Software and Services after any modifications, you agree to be bound by the revised Terms.
8.1 Reservation of Rights: We reserve the right to refuse service to any individual or entity for any reason, including but not limited to violations of these Terms, suspicious or fraudulent activity, unauthorized modifications to the Software, or misuse of data collected through our Software or Services.
8.2 Notification: In the event that we choose to exercise our right to refuse service, we may provide notice to the affected individual or entity at our discretion.
9.1 Informal Resolution: If you have any dispute with us regarding these Terms or your use of our Software or Services, you agree to first attempt to resolve the dispute informally by contacting us at admin@propkill.me.
9.2 Arbitration: If the dispute is not resolved through informal means, you agree that the dispute will be resolved by binding arbitration administered by an independent arbitration service, in accordance with the rules of the jurisdiction specified below.
10.1 Governing Law: These Terms are governed by the laws of the state of California, and the laws of the United States, without regard to its conflict of laws principles.
11.1 Force Majeure: We shall not be held liable for any delay or failure in the performance of our obligations under these Terms caused by events beyond our reasonable control, including but not limited to acts of nature, natural disasters, war, terrorism, government action, strikes, and failures of telecommunications or internet services.
12.1 Appeal Process for False Positives: If you believe that your account has been wrongly flagged for cheating or a false positive has been made, you may appeal by submitting a request to our support team at admin@propkill.me. We will review your case and provide feedback within 14 days of the request.
12.2 Refund Policy: If you believe you have been charged incorrectly or wish to request a refund, you must contact us within 5 days of your purchase. Refunds will only be issued for valid, substantiated claims and are subject to review.
13.1 Data Handling Procedures: We adhere to the privacy and data handling procedures defined in our Privacy Policy. Specific data handling procedures may apply depending on the jurisdiction in which you reside, especially in jurisdictions with stricter data protection laws like the European Union's GDPR.
14.1 Unauthorized Modifications: "Unauthorized modifications" include any changes to the game software or environment that attempt to alter the normal functioning of the game in order to gain an unfair advantage, such as modifying game files, using external tools, or altering game data.
14.2 Cheat Detection Criteria: Our cheat detection system utilizes behavior analysis, game logs, and technical detection methods to identify cheating activities. Criteria for detection may include abnormal gameplay patterns, unexpected system changes, or known cheat signatures.
14.3 Challenging False Positives: If you believe your account was mistakenly flagged for cheating, please refer to Section 12.1 (Appeal Process for False Positives). Our team will provide an explanation and may adjust your status if a mistake was made.
14.4 Prohibited Activities (Examples): Examples of prohibited activities include: a) using aimbots or wallhacks; b) exploiting game glitches or bugs for personal gain; c) using external software to manipulate game data; and d) attempting to bypass or tamper with the anti-cheat system.
